Redistributing Money among Employees

Effective today, it’s illegal to withhold or make deductions from tips and gratuities to cover damage, losses, spillage, breakage, etc. or cause employees to return tips and gratuities. Exception: “Tip pooling,” i.e., collecting and redistributing tips and gratuities and redistributing the money among employees, is allowed if the employer owns all or part of the business and regularly performs the same work as pool participants, such as a restaurant owner who also serves as a waiter.
