OK to Fire Worker for Threatening His Supervisor

The final straw for a poultry plant sanitation worker already on a short leash due to excessive absenteeism was a violent incident with his supervisor featuring a chest bump and verbal threats after learning that the supervisor was investigating him for goofing off instead of working. Although done in the heat of passion, the arbitrator ruled that the acts were just cause for not just discipline but termination given the worker’s target (i.e., his supervisor), his motivation (i.e., anger that the supervisor was investigating him which was, after all, the supervisor’s job) and his disciplinary track record [Unifor-Canada, Local 2216 v Eden Valley Poultry Inc, 2017 CanLII 84976 (NS LA), Dec. 13, 2017].
