No Evidence Employee Was Laid Off Because of His Age

A senior government employee claimed he was laid off because of his age. To prove his point, he pointed to the heading of his pink slip reading: “Notice of Layoff—Eligible to Retire” and noted that the layoff notice his younger colleague received didn’t include the latter “Retirement” phrase. But the Human Rights Tribunal was less than impressed. And because his other evidence of age discrimination and harassment was just as tenuous, it dismissed the case without letting it go to a hearing [Hamilton v Northwest Territories (Department of Transportation), 2018 CanLII 45119 (NT HRAP), May 17, 2018].
