Air Canada Mandatory Retirement Policy for Pilots ≠ Age Discrimination

Eighteen pilots forced to retire at age 60 claimed that Air Canada’s mandatory retirement policy was age discrimination and that previous Canadian Human Rights Commission rulings upholding the policy were wrong and, in any event, didn’t apply to their case. But the federal court disagreed and did what the 2 other courts asked to rule on the legality of the Air Canada mandatory retirement policy had done: dismissed the complaint [Gregg v. Air Canada Pilots Association, 2019 FCA 218 (CanLII), August 9, 2019].
